The defendant’s vulnerability to punitive damages, in such a case, depends upon his culpability tout court, not his culpability vis-à-vis the plaintiff.163 There is no strict inconsistency in supposing that, while the defendant’s liability to compensate B depends on whether he has mistreated her, his liability to pay punitive damages to her may depend on how gravely he has mistreated others. But the tension between these propositions is glaring, and it is unlikely that both of these propositions will survive any plausible attempt to work out the normative basis of liability to pay punitive damages.
